The meeting of the Board of Zoning Appeals (BZA) was called to order by President Laporte at 6:07 PM at the Village Hall.

 

ROLL CALL     Present:  Trustees Boddie, Bogat, Butterwick, Langford, Laporte, Lindstrom, MacKrell and Wilkes.  Absent: Trustee Al-Awar.

Others attending:  Atty. Laidlaw, ZPA Perry, Asst. Treasurer King, Mrs. Redies, Supt. Esch, BHMC President Bultman and applicants David Higbie and Dunrie Greiling.

 

APPLICATION FOR VARIANCE     60 Underdown Road

ZPA Perry summarized the application, which requests variance from Section 9.02(b) of the BHV Zoning Ordinance in order to construct an addition to a continuing non-conforming structure.  He noted that the addition is not at issue and meets all the requirements of the BHV Zoning Ordinance.  However, since the existing house intrudes into the side setback, it is a continuing non-conforming structure governed by Section 9.02.  The applicants were introduced to the Board.

Public Hearing  President Laporte convened the public hearing on this application at 6:09 PM.  One neighbor who lives across the street was present and stated that he fully supported the applicant’s request.  A letter received from another neighbor, also indicating no objection to the application, was noted (distributed to the BZA previously).There were no further comments from the public and the hearing was closed at 6:11 PM.

BZA Discussion  There was little discussion, with opinion expressed that there was no reason to deny the application.

Motion  Mr. Boddie moved that the application submitted by David Higbie and Dunrie Greiling, owners of the home at 60 Underdown Road, requesting variance from Section 9.02(b) of the Barton Hills Village Zoning Ordinance, be approved.  The requirement of this section prohibiting the expansion of a continuing non-conforming structure is waived relative to the addition being proposed for this property at this time.  Mr. Lindstrom seconded;  the motion carried.

 

APPROVAL OF MINUTES     Mr. Wilkes moved that the minutes of the June 8, 2009 Board of Zoning Appeals meeting be approved as printed.  Mr. Boddie seconded;  the motion carried.

 

NEW BUSINESS     None.

 

Mr. Boddie moved the meeting be adjourned at 6:13 PM.  Mr. Lindstrom seconded;  the motion carried.
