The regular meeting of the Board of Trustees was called to order by President Wilkes at 5:45 PM at the Village Hall.
ROLL CALL Present: Trustees Butterwick, Davis, Hensinger, Laporte, MacKrell, Pickl and Wilkes; Atty. Etter, Asst. Treas. Redies and Supt. Esch; BHMC President Bultman. Absent: Trustees Al-Awar and Boddie.
PUBLIC HEARING
President Wilkes convened the Public Hearing at 5:46 PM. The purpose of the Public Hearing was to receive public comment on the request for variance submitted by Mr. Walter Esch for replacement of an existing garage at 196 Barton Shore Drive, destroyed in a storm, as a continuing non-conforming use under Section 10.03(b) of the Barton Hills Village Zoning Ordinance. Mr. Wilkes verified with Mrs. Esch that proper notice of the request had been given in the newspaper and to the neighbors, and that sufficient application/documentation/fee payment had been received from Mr. Esch. He reviewed the details of the situation that led to this request. One letter was received from neighbor Nina Barwick, which was read aloud, stating that she had no objection to Mr. Esch’s request.
PUBLIC COMMENT None.
There being no comments or questions from either the public or the Board, President Wilkes closed the Public Hearing at 5:49 PM.
BARTON HILLS VILLAGE
BOARD OF ZONING APPEALS MEETING
April 19, 2004
President Wilkes convened the meeting of the Board of Trustees acting as Zoning Board of Appeals (sic) at 5:50 PM at the Village Hall. Present: Trustees Al-Awar, Boddie, Butterwick, Davis, Hensinger, Laporte, MacKrell, Pickl and Wilkes; Atty. Etter, Asst. Treas. Redies and Supt. Esch; BHMC President Bultman.
MOTION Mrs. MacKrell moved that the zoning variance requested by Mr. Walter Esch be approved. Mr. Butterwick seconded; the motion carried unanimously.
Section 10.07 of the Barton Hills Village Zoning Ordinance allows for the Board to choose that their decision become effective immediately rather than wait the stated five days if they feel it is necessary for the preservation of property or personal rights.
MOTION Mrs. MacKrell moved that the zoning variance granted to Mr. Walter Esch become effective immediately. Mrs. Hensinger seconded; the motion carried with Mrs. Laporte voting no.
Mr. Bultman asked how a variance could be granted if the drawings submitted with the application were insufficient for obtaining a building permit. The Board responded that it was reasonable for an applicant to delay obtaining detailed drawings until the question of the variance was settled. Mr. Al-Awar and Mr. Boddie arrived
Mr. Wilkes relayed to the Board that a request for variance was received from Drs. Vik and Bithika Kheterpal of 521 Hillspur Road. A special meeting of the Board of Trustees acting as Zoning Board of Appeals to consider this request was set for Tuesday, April 27, 2004 at the Village Hall at 5:45 PM. Mrs. Esch will send out appropriate notices.
There being no further business, the Zoning Board of Appeals meeting was adjourned at 6:04 PM.
