BARTON HILLS VILLAGE PLANNING COMMISSION MEETING

April 23, 2013

The regular meeting of the BHV Planning Commission was called to order by Chair Weingartner at 6:15 PM at the Village Hall.

ROLL CALL Present: Commissioners CMacKrell, JMacKrell, Richards, Wallace and Weingartner. Absent: Commissioners Curtner and Zoldan. Others present: ZPA Perry and consultant Dick Carlisle.

PUBLIC COMMENT None.

MINUTES The minutes of the January 22, 2013 meeting were approved as printed. (Wallace/JMacKrell/P unanimously)

COMMUNICATIONS/ANNOUNCEMENTS None.

REPORTS None.

UNFINISHED BUSINESS Zoning Ordinance Discussion of the draft dated 4/19/13 included:

–Language regarding adult foster care family homes (six residents or less; definitions page 3, Section 4.05 page 20) reflects federal/state law that protects certain classes of these homes as a permitted use in residential districts.

–Language regarding family day care homes (six children or less; definitions page 5, Section 4.05 page 21, Section 7.04 page 50) and group day care homes (twelve children or less; definitions page 6, Section 4.05 page 21, Section 7.04 page 50) reflects federal/state law that this may be a special use in residential districts. Villages have the authority to regulate such homes according to standards and to determine compatibility with the neighborhood.

–Language regarding places of worship (definitions page 7, Section 4.05 page 20, Section 7.04 page 44) reflects federal legislation protecting such places from zoning discrimination. These are listed as a special use in the residential district.

–Regarding day care homes and places of worship the consultant advised inclusion which allows for review/regulation by BHV via the zoning ordinance rather than omitting these uses and having a challenge decided in court

–Language regarding wireless communications (definitions page 10, Section 4.06 page 21, Section 7.04 page 44) adheres to federal standards that have recently been changed to require colocation when feasible.

–Off street parking chart (page 58). Mr. Carlisle will update this chart.
