The meeting of the Board of Zoning Appeals (BZA) was called to order by President Laporte at 6:05 PM at the Village Hall.

 

ROLL CALL     Present:  Trustees Al-Awar, Boddie, Langford, Laporte, Lindstrom, MacKrell and Wilkes.  Absent: Trustees Bogat and Butterwick.

Others attending:  Atty. Laidlaw, ZPA Perry, Asst. Treasurer Redies, Supt Esch and applicant Stewart Gordon.

 

APPROVAL OF MINUTES     Mr. Lindstrom moved that the minutes of the May 11, 2009 Board of Zoning Appeals meeting be approved as printed.  Mrs. Langford seconded;  the motion carried.

 

APPLICATION FOR VARIANCE     192 Barton Shore Drive

Public Hearing  President Laporte convened the public hearing at 6:06 PM concerning the application from Stewart Gordon and Sara Duvall, 192 Barton Shore Drive, to construct a privacy fence in the set back.  Written comments received prior to the meeting were previously distributed to the Board members by email.  There were no further comments from the public and the hearing was closed at 6:07 PM.

BZA Discussion  Mr. Gordon was invited to address the Board.  He stated that the proposed fence would provide a privacy barrier between his deck and the entrance to the home at 196 Barton Shore Drive owned by Walter Esch (currently occupied by a tenant.)  The size of the fence was dictated by the sight lines between the houses and would not be any longer than the 12 feet proposed (8-9 feet in height).  Mr. Esch was asked for comment;  he had no objections to the proposal.  The tenant also supports the project and has been involved in the planning/design of the fence.  The fence will be entirely on the Gordon/Duvall property just inside the property line.

Motion  Mr. Boddie moved that the application for variance from Section 5.03(c) of the Barton Hills Village Zoning Ordinance to construct a privacy fence in the set back at 192 Barton Shore Drive submitted by owners Stewart Gordon and Sara Duvall be approved contingent on the fence being installed as shown on the plans submitted with the application.  Practical difficulty was established, based on the unusual narrowness of the lot and close proximity of the house to the neighboring house.  Mr. Wilkes seconded;  the motion carried.  Further, Mr. Boddie moved that the five day waiting period required by Section 10.07 of the Barton Hills Village Zoning Ordinance be waived relative to this variance.  Mr. Al-Awar seconded;  the motion carried.

 

APPLICATION FOR VARIANCE     192 Barton Shore Drive

Public Hearing  President Laporte convened the public hearing at 6:13 PM concerning the application from Stewart Gordon and Sara Duvall, 192 Barton Shore Drive, to construct a garden shed in the set back.  Written comments received prior to the meeting were previously distributed to the Board members by email.  There were no further comments from the public and the hearing was closed at 6:14 PM.

BZA Discussion  Mr. Gordon was invited to address the Board.  He explained that locating the garden shed within the required set back would put it either right in the middle of the back yard, or in a very wet location.  Walter Esch, owner of the neighboring property at 196 Barton Shore Drive, had no objections to the project provided the shed was not located in the old roadway.  The structure will be painted the same color as the house, with a similar roof line.  Motion  Mrs. MacKrell moved that the application for variance from Section 5.03(c) of the Barton Hills Village Zoning Ordinance to construct a garden shed within the set back submitted by Stewart Gordon and Sara Duvall, 192 Barton Shore Drive, be approved contingent on the shed being constructed as shown on the plans submitted with the application.  Practical difficulty was established, based on the unusual narrowness of the lot, close proximity of the neighboring house and existing topography of the lot.  Further, the five day waiting period required by Section 10.07 of the Barton Hills Village Zoning Ordinance is waived relative to this variance.  Mr. Boddie seconded;  the motion carried.
