ZONING BOARD OF APPEALS

BARTON HILLS VILLAGE

 

 May 10, 2021

 

The meeting of the Zoning Board of Appeals was called to order by President Smith at 6:00 PM via online video/phone conference due to the COVID-19 pandemic.

 

ROLL CALL     Present:  Trustees Al-Awar (Barton Hills Village, Washtenaw County, MI), Benson (Barton Hills Village, Washtenaw County, MI), Conlin (Barton Hills Village, Washtenaw County, MI), Haitam (Barton Hills Village, Washtenaw County, MI), Hensinger (Barton Hills Village, Washtenaw County, MI), Holmes (Barton Hills Village, Washtenaw County, MI), Popp (Barton Hills Village, Washtenaw County, MI), and Smith (Barton Hills Village, Washtenaw County, MI).   Absent:  Trustee Nicoli.

Others attending:  Asst. Treasurer Carey, Supt. Hnatow, ZH Malan, BHMC President Curtner, eight residents, two project representatives and one guest.

 

APPROVAL OF MINUTES     Minutes of the September 14, 2020 Zoning Board of Appeals meeting were approved as printed.  (Al-Awar/Hensinger/P)

 

APPLICATION FOR VARIANCE     260 Barton North Drive

 

Project Presentation     Variance was requested for construction of an outdoor swimming pool less than 35 feet from the property line.  The pool would be located on the back side of the new home being constructed.

 

Public Hearing     The Public Hearing was convened at 6:24 PM.  There being no public comment, the hearing was closed at 6:26 PM.

 

Discussion/Decision     Regarding practical difficulty, the owner’s representative stated that locating the pool on the west side of the house would be hazardous due to the significant slope from the house down to the side yard and lack of adequate access.  The proposed location offers the safest access from the house/patio and would be least visible to neighbors.  It was noted that the back of the house faces undeveloped BHMC land and that east and west neighbors are shielded by trees/vegetation.  BHMC President Curtner had no objections on behalf of the corporation.

 

Motion     Request for variance from Section 5.07(4) of the Barton Hills Village Zoning Ordinance to allow construction of an outdoor swimming pool less than 35 feet from a lot line at 260 Barton North Drive, per the plans dated April 14, 2021, was approved.  (Haitam/Popp/P with Al-Awar voting no)
