MINUTES OF BOARD MEETING
TRUSTEES OF BARTON HILLS VILLAGE
July 10, 2023
The regular meeting of the Board of Trustees was called to order by President ProTem Conlin at 6:02 PM at Walter Esch Hall.
ROLL CALL Present: Trustees Al-Awar, Conlin, Darden, Haitam, Hensinger, Perry, Popp, and Smith. Absent: Trustee Holmes.
Others attending: ZA Capozza, Supt. Hnatow, BHMC President David, State Senator Sue Shink, State Rep. Jennifer Conlin, four residents, and three guests.
MINUTES Minutes of the June 12, 2023 Trustees meeting were approved with the following addition: UNFINISHED BUSINESS: The proposed Code amendment was approved for distribution via the Barton Bulletin to the residents for public comment. (Perry/Smith/P with Al-Awar and Haitam voting no on Supt. purchase authority not to exceed $20K each instance.) (Popp/Al-Awar/P)
PUBLIC COMMENT
Motion: Amend the agenda to move public comment to after approval of minutes. (Perry/Al-Awar/P)
–2 residents and 2 guests voiced their concerns regarding the M-14/Barton Drive MDOT exploration.
–2 residents expressed their distress regarding the 320 Juniper Lane projects.
–State Senator Sue Shink and State Rep. Jennifer Conlin introduced themselves and expressed their support to the Village/Community.
–BHMC President David shared that the Board of Directors will meet on July 11, 2023 to:
1) Discuss proposals regarding Architectural Review and increased fees for major projects.
2) Appoint an interim to fill their vacant seat.
–Written comment regarding the M-14/Barton Drive MDOT exploration was distributed.
LIQUOR SALES RESOLUTION The following resolution was adopted. (Popp/Darden/P)
WHEREAS, a review of the records of the Village of Barton Hills Village reveals that the question of the sales of spirits and mixed spirit drink, in addition to beer and wine, for consumption on the premises has not been submitted as a referendum to the electors of this governmental unit; and
WHEREAS, the Clerk of Barton Hills Village by his signature below certifies that the above mentioned review statement is accurate;
NOW THEREFORE BE IT RESOLVED that the sale of spirits and mixed spirit drink, in addition to beer and wine, shall be permitted for consumption on the premises within the Village of Barton Hills Village under the provisions of the Michigan Liquor Control Code of 1998, MCL 436.2101(1)
PROPOSED CODE REVISION No public comment was received following publication of the proposed amendments to the Village code.
Motion: Limit the Supt. spending authority to $5,000. (Al-Awar/Haitam/F with Conlin, Darden, Hensinger, Perry, Popp and Smith voting no)
Motion: A homeowner may operate power tools on the homeowner’s property between 8:00a.m. and 10:00p.m. any day. (Al-Awar/Haitam/P)
Motion: Remove the $500 fine for speed limit violations and leave as determined by Michigan law. (Al-Awar/Haitam/P)
Ordinance No. 60 to recodify the Village code was adopted. (Smith/Darden/P with Haitam voting no)
FINANCE (Smith/Carey) The Cash Disbursements for June 2023 were approved as printed (Aux. Book IV G(5)). (Al-Awar/Haitam/P)
–Committee will draft a capital equipment replacement schedule for Trustee review.
–The Flagstar Bank investment proposal was activated, and all funds have been shifted to Flagstar Bank.

Zoning Administrator (Capozza) Mentioned an upcoming project.
Planning Commission (Hensinger) No report. The Commission will meet July 18, 2023.

UNFINISHED BUSINESS MDOT/M-14 PEL Study update (Smith). The Trustees approve the following statements:
1) BHV strongly opposes closing the M-14 EB Barton Drive ramp.
2) BHV strongly urges MDOT to rapidly implement Safety measures within M-14’s Barton Dr/Whitmore Lake Rd/Main St interchange as documented in MDOT’s
August 31, 2021 Road Safety Audit.
3) BHV strongly urges MDOT to eliminate the dual roundabout (dog bone) as an alternative.
–Approve the recommended Action Plan.
–Approve the recommended Call to Action. (Smith/Darden/P)
NEW BUSINESS The Christmas tree located outside the Village Hall will be dedicated to Dave and Jan Esch.
There being no further business or objections, the meeting was adjourned at 7:41 PM.
